Terms and Conditions of Use
Last updated: 19 June 2026. Please read these Terms and Conditions of Use (“Terms”) carefully before accessing or using this Website. By accessing or using the Website you accept these Terms in full. If you do not accept them, you must not use the Website.

2. Definitions
- “Website” / “Platform” means thenls.com and any related sites, sub-domains, member areas and tools we operate.
- “Member” means a real estate professional (estate agent or broker) acting in the course of their business who has subscribed to a paid membership.
- “Public User” means any visitor using the public areas of the Website who is not a Member.
- “Member Content” means listings, property descriptions, text, photographs, images, video, floor plans, prices and other materials a Member submits.
- “Our Content” means all content we provide: articles, reports, calculators, comparables, search results, software, graphics, AI-generated outputs and the selection and arrangement thereof.
- “Services” means the functionality described in Section 4.
3. Acceptance and changes to these Terms
Use of the Website constitutes acceptance of these Terms. We may update these Terms to reflect changes in the law or in our Services. The version in force is the one published here; material changes affecting Members will be notified by email or on first login after the change. Continued use after a change constitutes acceptance.
4. The Service
The NLS is a B2B real estate platform for estate agents and brokers operating in Spain (and certain other markets). The Website is not a licensed estate agency and is not a party to any property transaction. Our Services include, depending on membership and role:
- Property listings & search — Members publish listings (directly or via authorised XML/MLS feeds); Public Users may search and contact the relevant agent directly.
- AI assistants — automated chat assistants (“Shannon”, “Polly”) that help with search and information. AI outputs are generated automatically, may contain errors, and do not constitute professional, legal, financial or valuation advice (see Section 9).
- Document generation & electronic signature — tools to generate standard real estate documents and sign them electronically via our e-signature provider (see Section 10).
- Transactions / deal management — tools for Members to manage deals and related documents.
- The NLS Academy — online training and accreditation courses.
- Communications — email, newsletters and, where a Member opts in, WhatsApp messaging used to operate the Services and support onboarding.
- Feed syndication — optional outbound distribution of a Member’s listings to third-party portals where the Member has granted permission.
We do not work directly with property sellers or buyers, do not arrange viewings, and are not involved in negotiating or concluding sales or leases.
5. Eligibility
Membership is reserved for real estate professionals acting in the course of their trade or profession (B2B). By subscribing you confirm that you are a duly authorised estate agent or broker in the jurisdiction in which you operate and that you use the Services for professional purposes. Public Users may use the public areas without a membership.
6. Accounts and security
You are responsible for the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that breach these Terms.
7. Membership, fees, billing and renewals
- Fees: membership is offered in several plans (currently €75, €99 and €199 depending on the plan and billing period). All prices are exclusive of IVA, which is added at the legally applicable rate. The plans and prices in force are those displayed at checkout.
- Recurring billing: memberships are subscriptions that renew automatically at the end of each billing period using your stored payment method, until cancelled.
- Cancellation: you may cancel at any time from your account or by emailing [email protected]; cancellation stops future renewals and takes effect at the end of the current paid period.
- Withdrawal: as membership is contracted by professionals for purposes relating to their business activity, the 14-day right of withdrawal for consumers under Royal Legislative Decree 1/2007 (TRLGDCU) does not apply. Save as required by law, fees already paid are non-refundable.
- Price changes: we may change fees with prior notice; changes apply from the next renewal.
8. Member Content and listings
Members are solely responsible for the accuracy, legality and rights clearance of their Member Content, including holding any required mandate/listing authorisation and respecting data protection and advertising rules. You grant The NLS a non-exclusive, worldwide licence to host, display, reproduce and distribute your Member Content for the purpose of operating and promoting the Services (including agreed feed syndication). You must not list property you are not authorised to market. We may remove content that is unlawful, inaccurate or in breach of these Terms.
9. Artificial-intelligence features
Certain features use automated/AI systems (including third-party large-language-model providers). AI-generated content is provided “as is” for convenience, may be inaccurate or incomplete, and must not be relied upon as professional, legal, financial, tax or valuation advice. You remain responsible for verifying any output before relying on or communicating it. Use of AI features may involve transferring the relevant input to our processors (see Section 14).
10. Electronic documents and signatures
Document-generation templates are provided as a convenience and do not constitute legal advice; you are responsible for ensuring a document is appropriate for your purpose. Electronic signatures are processed through our e-signature provider and are intended to function as advanced electronic signatures within the meaning of Regulation (EU) No 910/2014 (eIDAS). You are responsible for the lawful use of the signing tools and for the content you submit for signature.
11. Acceptable use
You must not: use the Website unlawfully or in breach of third-party rights; scrape, harvest or bulk-extract content or data; introduce malware; attempt to gain unauthorised access; misuse listings or contact data; or use the Services to send spam or unlawful communications. We may suspend access for breach.
12. Intellectual property
Our Content and the Website (including software, design, trademarks and databases) are owned by or licensed to The NLS and protected by Spanish and international intellectual-property law. You are granted a limited, revocable, non-transferable licence to use the Website for its intended purpose. No other rights are granted.
13. Third-party services and links
The Website integrates and links to third-party services (e.g. mapping, payment, messaging, e-signature and AI providers). We are not responsible for third-party content or services, which are governed by their own terms.
14. Data protection
We process personal data as data controller in accordance with Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 (LOPDGDD) and our política de privacidad, which forms part of these Terms. Operating the Services involves processors that may be located outside the EEA (including providers in the United States such as our AI, email and messaging providers); such transfers are made under appropriate safeguards (e.g. Standard Contractual Clauses). You may exercise your rights of access, rectification, erasure, restriction, portability and objection, and lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es), as described in the Privacy Policy.
15. Cookies
The Website uses cookies and similar technologies as described in our Política de cookies. Non-essential cookies are used only with your consent.
16. Warranties and disclaimers
We provide the Services with reasonable care and skill. To the extent permitted by law, the Website and Our Content are provided “as available”; we do not warrant that listings or third-party data are accurate or that the Website will be uninterrupted or error-free. Nothing in these Terms excludes liability that cannot be excluded under Spanish law.
17. Limitation of liability
To the maximum extent permitted by applicable law, The NLS shall not be liable for indirect or consequential loss, loss of profit, business or data arising from use of the Website, nor for the acts, content or omissions of Members or third parties. Nothing limits our liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.
18. Indemnity
As a Member acting professionally, you agree to hold The NLS harmless from claims, losses and reasonable costs arising from your Member Content, your breach of these Terms or your unlawful use of the Services.
19. Term and termination
These Terms apply while you use the Website. We may suspend or terminate access for breach. Provisions which by their nature should survive termination (intellectual property, liability, governing law) will survive.
20. Governing law
These Terms are governed by Spanish law.
21. Jurisdiction and complaints
For Members (professionals), any dispute shall be submitted to the Courts and Tribunals of Marbella (Málaga), Spain. Where the user is a consumer, the competent courts shall be those provided for by applicable consumer law (generally the consumer’s place of residence), and the consumer may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. 22. Miscellaneous
If any provision is held invalid, the remainder continues in force. These Terms constitute the entire agreement regarding use of the Website. The English text is the operative version; any translation is provided for convenience.
